Terms of Service & Communications Consent

By creating an account, claiming a listing, or using BACKd Vegas (“BACKd”, “we”, “us”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not create an account.

You must be at least 18 years old and, if signing up on behalf of a business, authorized to bind that business.

You are responsible for the accuracy of the information you submit and for keeping your login credentials secure. We may edit, suspend, or remove listings, reviews, or accounts that violate these Terms, contain false claims of ownership, or that we reasonably believe are fraudulent, unlawful, or abusive.

Reviews must be first-hand, honest, and free of unlawful, defamatory, or harassing content. Incentivized or fake reviews are prohibited.

This section is the express written consent you provide at sign-up. Please read it carefully.

By checking the communications consent box, you expressly authorize BACKd Vegas and its affiliates, service providers, and marketing partners acting on our behalf to contact you at the phone number(s), email address(es), and messaging handles you provide (or later provide or update), including a wireless/mobile number, for marketing, promotional, transactional, account, billing, verification, survey, and customer-support purposes.

You specifically consent to receive:

• SMS and MMS text messages, including recurring marketing texts;
• Telephone calls, including outbound and inbound calls;
• Calls and messages delivered using an automatic telephone dialing system (ATDS/autodialer), predictive dialer, prerecorded or artificial voice, ringless voicemail, and artificial-intelligence (AI) generated or AI-assisted voice and messaging agents;
• Email, push notifications, and in-app messages.

Consent to receive marketing calls or texts is not a condition of purchasing any goods or services, and it is not required to create a free BACKd listing or account.

Message frequency varies. Message and data rates may apply. Calls and messages may be monitored, recorded, and transcribed for quality, training, compliance, and AI model performance purposes to the extent permitted by law; where two-party consent is required, you consent to that recording.

How to opt out: reply STOP to any text to stop texts (reply HELP for help), tell any live or AI agent to place you on our internal do-not-call list, use the unsubscribe link in any email, or email support@backdvegas.com. Opting out of marketing does not stop transactional or account-related messages (such as password resets, claim approvals, or billing notices), which are part of the service.

You represent that you are the subscriber or customary user of any number you provide and that you are authorized to give this consent. You agree to notify us promptly if a number is reassigned or no longer belongs to you.

If you submit contact information for a business, you represent that you have authority to receive communications at that number on behalf of the business and that providing it does not violate any agreement or law.

Premium plans are billed in advance on a recurring basis at the price displayed at checkout and renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.

You retain ownership of content you submit and grant BACKd a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt, and promote that content in connection with operating and marketing the directory.

BACKd is provided “as is” without warranties of any kind. We do not guarantee the accuracy of listings, ratings, third-party review data, or business availability. To the maximum extent permitted by law, BACKd’s total liability arising out of or relating to the service is limited to the greater of the amounts you paid us in the twelve months before the claim or $100, and we are not liable for indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify and hold BACKd harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the service, the phone numbers or contact details you supply, or your breach of these Terms.

Except for small-claims matters and requests for injunctive relief, any dispute between you and BACKd will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Clark County, Nevada. You and BACKd waive any right to a jury trial and to participate in a class, collective, or representative action. You may reject this arbitration agreement by emailing support@backdvegas.com within 30 days of creating your account.

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. We may update these Terms; material changes will be posted here with a new version date, and continued use after the effective date constitutes acceptance. Consents you previously gave remain in effect until you withdraw them.
